Terms of Service

1. About These Terms

These Terms of Service (“Terms”) govern your access to and use of TPT Backup (“the Service”), operated by TPT Solutions Ltd (“we”, “us”, “our”), a company incorporated in New Zealand. By creating an account or using TPT Backup, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

TPT Backup is a cloud backup service that allows you to store files, back up photos from your mobile device, and archive emails from any IMAP inbox. The free tier includes 5 GB of storage. Paid plans provide additional storage and features. We may update, modify, or discontinue features at any time and will give reasonable notice of material changes.

3. Account Registration

• You must create an account to use TPT Backup. You must be at least 16 years old.
• You must provide accurate and complete information when registering.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must notify us immediately of any unauthorised use of your account at support@tptsolutions.co.nz.

4. Your Content

You retain ownership of all files, photos, and emails you store through TPT Backup. By uploading content, you grant us a limited licence to store, process, and transmit your content solely to provide the Service. We do not access, analyse, or use your content for any other purpose.

You are solely responsible for ensuring that any content you upload does not violate applicable laws, third-party rights, or these Terms.

5. Acceptable Use

You agree not to use TPT Backup to:

• Store or transmit content that is illegal, harmful, or infringes any third-party rights.
• Circumvent storage quotas or usage limits.
• Attempt to gain unauthorised access to our systems or other users' accounts.
• Use the Service to distribute spam, malware, or malicious code.
• Resell or sublicense access to the Service without our written permission.

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Storage Quotas and Paid Plans

• The free tier includes 5 GB of storage. Paid plans provide additional storage as described on our pricing page.
• If you exceed your storage quota, new uploads may be paused until you free up space or upgrade your plan.
• Subscription fees are billed in advance. You may cancel at any time; your access continues until the end of the current billing period.
• Refunds are not provided for unused portions of paid billing periods, except where required by the New Zealand Consumer Guarantees Act 1993.

7. Data Availability and Backups

While we take reasonable measures to ensure reliability and availability, TPT Backup is not guaranteed to be uninterrupted or error-free. We recommend maintaining additional copies of critical data. We are not liable for any loss of data resulting from service interruptions, hardware failures, or other unforeseen events.

8. Account Termination

You may delete your account at any time from within the app. Upon deletion, your backed-up content will be permanently removed within 30 days. We may suspend or terminate your account for violation of these Terms, with notice where reasonably practicable.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost. TPT Backup is a supplementary backup tool and should not be your sole copy of critical data.

10. Limitation of Liability

To the maximum extent permitted by law, TPT Solutions Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising from your use of or inability to use the Service. Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence, or any liability that cannot be excluded by law.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered account holders by email at least 14 days before material changes take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts, unless otherwise required by mandatory consumer protection laws in your jurisdiction.
